Weeks after suing Utz Brands over Boulder Canyon chips, the firm takes on the brand that calls itself "America's #1 Avocado Oil" - UC Davis testing found every Chosen Foods product examined failed, in every lot
NEW ORLEANS, LA / ACCESS Newswire / September 17, 2026 / Daly & Black, P.C. is now litigating its second avocado oil false advertising class action in the U.S. District Court for the Eastern District of Louisiana.
The case, Hebert v. Chosen Foods LLC, alleges Chosen Foods marketed products as "100% Pure Avocado Oil" - and guaranteeing that purity - when independent testing found the oil inside was inconsistent with authentic avocado oil. Named plaintiff Karoline Hebert, a New Orleans consumer, paid $14.79 per unit for Chosen Foods 100% Pure Avocado Oil Spray and bought Classic Mayo repeatedly. She is represented by Blake E. Corley and Richard G. Perque.
Eight lots. Eight failures.
Both of the firm's cases trace to one peer-reviewed study, published July 2026 in Applied Food Research by researchers at UC Davis. Four Chosen Foods products were tested (Classic Mayo, Vegan Mayo, Lemon Garlic Dressing & Marinade, and Zesty Italian Dressing & Marinade) and according to the complaint, all four came back inconsistent with authentic avocado oil in both production lots examined. Across the full study, 89 percent of 54 avocado oil-labeled products failed, including every salad dressing tested. Only 1 of 20 olive oil products failed under the same method.

The complaint alleges Chosen Foods marketed itself as one of the few brands that could guarantee 100% purity, told consumers it tested every batch and traced its oil from grove to bottle, and in January 2026 ran a national campaign built on keeping seed oils out of food.
The complaint also alleges the Texas Attorney General issued Chosen Foods a civil investigative demand on August 20, 2026.
The claims
Seven causes of action, including breach of express warranty, redhibition, violation of the Louisiana Unfair Trade Practices Act, fraud in the inducement, and unjust enrichment - on behalf of a proposed nationwide class and Louisiana subclass of purchasers since June 6, 2023. The complaint estimates hundreds of thousands of consumers and damages exceeding $5 million.
