According to White River Energy Corp.'s SEC filings, the company represented that it had acquired approximately $5.5 billion in federal income tax credits purportedly issued to a Native American tribe. The credits were marketed at a substantial discount with the expectation that purchasers could use them to offset federal income tax liabilities.
Federal authorities have since raised serious questions regarding the legitimacy of the purported credits. The IRS informed the U.S. Senate Committee on Finance that the credits "do not exist" and warned that taxpayers claiming nonexistent credits may face examination and penalties. In January 2026, Senate Finance Committee Ranking Member Ron Wyden called for SEC action against White River and disclosed that the company was under criminal investigation by the Department of Justice concerning its sale of the purported credits.
