CHICAGO, IL / ACCESS Newswire / March 11, 2025 / Recently, the Northern District of Illinois denied AbbVie's motion to dismiss a lawsuit alleging that AbbVie violated the Illinois Genetic Information Privacy Act ("GIPA").

In Henry v. AbbVie, Inc. (N.D. Ill. Case No. 23-cv-16830), it is alleged that AbbVie improperly asked prospective employees about their family medical histories during pre-employment physical examinations. AbbVie moved to dismiss the lawsuit, arguing that Mr. Henry failed to allege a violation of GIPA because family medical history was not genetic information. The Court disagreed with AbbVie and denied the motion, finding that family medical history was part of the definition of "genetic information," and if AbbVie asked for family medical history, that was sufficient to allege a violation of Section 25 of GIPA.

The lawsuit seeks to represent all individuals who had a physical examination in connection with employment with AbbVie in Illinois in the past five years where family history was requested.
