THE LAWSUIT: A class action securities lawsuit was filed against Beta Bionics, Inc. that seeks to recover losses of shareholders who were adversely affected by alleged securities fraud between July 30, 2025 and February 24, 2026.

It was misleading for Saint to tell investors, that the Form 483 concerned only a minor difference in interpretation of reporting rules, and that the complaints to be back-filed were only benign reports requiring no hospitalization, when, in fact, the Form 483 identified over 18,000 complaints out of less than 30,000 total iLet users, including numerous life-threatening hypoglycemic events that the Company had "failed to investigate," or even report to the FDA, with no justification. Saint and Feider further misled investors by assuring them that the Company's remediation efforts were advanced and the FDA's issues were very benign," when they failed to accurately describe the scope and severity of the FDA's observations which made remediation much more complex and extensive than defendants indicated to investors. Lastly, it was misleading for Saint to stress that complaint could be extremely benign, and that there was no "underlying problem in our data here," while omitting that the Company had in fact received hundreds of complaints of life-threatening events requiring hospitalization, and that the FDA had raised this issue in its Form 483.
